LES Benelux Topic Meeting

In today’s economy where “knowledge is power”, Trade Secrets and Confidential Business Information undoubtedly are major strategic assets of most companies, whatever their size and sector. They provide the companies with competitive edge and are often an instrumental element of a company’s unique selling proposition. They have often taken years and years of R&D to be developed and they encapsulate a wealth of expertise. They are therefore essential assets, although probably the most intangible ones. Their vulnerability puts businesses at risk. Their loss can be extremely damaging. Their proper protection against misappropriation is therefore of crucial importance. Despite this context, their protection has often been overlooked. Compared to other legal means of protection, Trade Secrets and Confi dential Business Information are often considered second. Their regulation is less effi cient and their enforcement is less harmonised and predictable. Not all necessary operational measures are always put in place for their effective safeguard either. In this meeting, we will try to shed light on these issues and help attendees to improve their own strategy of protection of these assets by discussing legal, business and operational issues that should be considered from an international perspective.
